Justice Weinstein is now conferencing all cases that are 3rd time on, and many cases are expected to go to trial 3rd time on even if standards and goals is months away. He is no longer allowing the plaintiffs to vacate a Note of Issue or 325d the case to avoid an impending trial if the case is otherwise ready. If your case has this marking “Fin(T),” be ready to proceed to trial that day.
As of August 1, 2016, the briefing schedule for motions will be strictly enforced. For example, if a motion is “adjourned to December 1st with Opp to be served by Nov. 10th,” any opp served after Nov 10th will be rejected by the court UNLESS Reply is submitted. This is very rarely negotiable even if the parties consent. Be very careful. Motions submitted without Opp may result in malpractice. The court is not concerned with this possibility.
Not having a working copy of your e filed motion will result in it being marked off on call of the calendar. There is no longer a “second call” while you go print it.
Judge Donna Golia has taken over the PT 20/325d transfer cases which was previously run by Judge Orlow. She requires all parties to be fully prepared with facts, discovery status, motion status and settlement status. Appearing attorneys must be authorized to discuss settlement or an attorney who is authorized must be a phone call away. Be fully prepared for a real conference. If your case is marked final for trial, be ready to go.
